2. Scope

These Terms of Service apply to orders placed through our online shop.

They apply to customers purchasing products from JS E-Commerce GmbH. Any terms provided by the customer only apply if we have expressly agreed to them.

3. Products

We sell products through our online shop. Some products may be custom-made or personalised according to the customer’s specifications.

For custom products, the customer may provide information, text, names, images, files or other details required to create the product.

The main features of each product are shown on the relevant product page.

4. Orders and contract formation

You can select products in our online shop and place them in the shopping cart.

Before submitting your order, you can review your order details and correct input errors.

By submitting your order through the final checkout button, you place a binding order for the products in your shopping cart.

After the order has been placed, you will receive an order confirmation by email.

You are responsible for ensuring that the email address provided during checkout is correct and that emails from us can be received.

5. Custom products and customer content

For custom or personalised products, production is based on the information, files and content provided by the customer.

The customer is responsible for ensuring that all submitted content is correct, complete and suitable for production. This includes names, spelling, dates, text, images, photos, designs and other personalisation details.

The customer must ensure that submitted content does not violate applicable laws or third-party rights, including copyright, trademark rights, name rights, personality rights or other intellectual property rights.

If claims are made against us because of content provided by the customer, the customer must indemnify us against such claims and reasonable related costs, to the extent that the claim is caused by the customer’s content.

We may refuse to process content that is unlawful, discriminatory, offensive, harmful, violent, extremist or otherwise unsuitable.

6. Prices and payment

The prices shown in the online shop apply at the time of the order.

Available payment methods are shown during checkout.

Payment may be processed through external payment service providers. The availability of individual payment methods may depend on the payment provider, order value, delivery country or technical availability.

7. Shipping and delivery

Delivery conditions, delivery times and any delivery restrictions are shown in the online shop, on the product page or during checkout.

Goods are delivered to the delivery address provided by the customer during checkout.

If delivery cannot be completed because the customer provided incorrect delivery information or failed to accept delivery, any additional costs may be charged to the customer.

8. Returns, exchanges and refunds

Our return and refund rules are set out in our separate Refund Policy.

Custom items cannot be cancelled or returned due to the nature of the product. For custom items, we only offer replacements.

Non-custom items may be returned according to the conditions stated in our Refund Policy.

9. Warranty

All products have a 30-day warranty, as stated in our Refund Policy.

If a product is defective, damaged or not as described, please contact us so we can review the issue.

For custom products, an error caused by incorrect, incomplete or unsuitable information provided by the customer is not considered a defect if the product was produced according to the submitted information.

10. Use of the online shop

The customer must not misuse the online shop or use it in a way that violates applicable law or the rights of others.

We do not guarantee that the online shop will always be available without interruption or errors.

We may update, change or temporarily suspend parts of the online shop where necessary.

11. Limitation of liability

To the extent permitted by applicable law, we are not liable for indirect, incidental or consequential damages.

Nothing in these Terms of Service limits rights that cannot be limited under applicable law.

12. Applicable law

German law applies, unless mandatory consumer protection laws provide otherwise.

The UN Convention on Contracts for the International Sale of Goods does not apply.

13. Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
